Owners warrant the vessel is capable of maintaining and shall maintain throughout the period of the Charter Party, from beginning sea passage to end sea passage, excluding any voyage up to 36 hours duration, up to and including Beaufort Scale 4 and Douglas Sea State 3, with no adverse currents, and with combined wave and swell heights NTE 1.25m, being on even keel and excluding periods during reductions of speed for safety, avoiding piracy threats, congestion or reduced visibility, etc.
Referring to vessel speed and consumption it is agreed that 'About' is defined as 5% more on bunker consumption and 0.5 knots less on vessel speed. Any performance evaluation report submitted to Owners must reflect all related terms agreed in vessel's description including the off-sets and allowing for both 'abouts'.

All bunkers supplied to be free of any and all waste marine or automotive lubricants or waste chemicals.
No co-mingling of different bunker grades or stems.
Any saving in consumption must be off-set against any reduction in speed, any saving in time must be off-set against any excess consumption, any saving in FO must be off-set against increased MGO and vice versa, and any overall saving on individual passage(s) must be set off against an overall loss on other individual passage(s).
Cost and time (including any deviation time required to meet SECA requirements and/or national regulations in operation in ports to which vessel is bound) incl ballast exchange to be for Charterers' account. Under no circumstances will any claim be deducted from hire unless and until it has been agreed by both parties.
Vessel has liberty to consume MGO when maneuvering, in/out of ports, starting auxiliary engine, navigation in shallow/restricted/congestion/poor visibility, canal, straits and rivers.
If Vessel's underwater hull or propeller is fouled as a result of extended idle time (20 days), then the Charterer is to clean the hull and propeller at Charterer's time and expense. The speed and consumption warranty shall be suspended only until the hull and propeller have been cleaned.
