FOR HEAVY CARGOES, MASTER SHALL HAVE THE RIGHT TO REMOVE SPILL PLATE OF GRAB TO REDUCE VOLUME. GEARS/GRABS NOT TO BE USED UNLESS EXPRESSIVELY SPECIFIED IN CP. (FOR GRAIN, FERTILIZER, SUGAR AND SIMILAR TYPE CARGO MINOR LEAKAGE ACCEPTABLE). 

 

BALLASTING:

FOR THE SAFE PERFORMANCE OF THE VESSEL, WHEN IN LONG BALLAST VOYAGE TO CROSS OCEANS, IT IS MASTER’S ABSOLUTE DISCRETION TO HEAVILY BALLAST THE SHIP, INCLUDING FLOODING OF NO 3 HOLD. BALLASTING / DE-BALLASTING / CLEANING TIME OF HOLD, AS WELL AS DRYING-UP TIME AFTER WASHING WITH FW, TO BE FOR CHARTERERS' ACCOUNT. BALLASTING / DE-BALLASTING OF HOLD NO 3 TO BE EFFECTED / EXECUTED IN A SAFE PORT OR SAFE/SHELTERED ANCHORAGE, NOT ENROUTE DURING SAILING. IT IS NOT ALLOWED TO PARTIALLY BALLAST CARGO HOLD NO 3 FOR ANY REASON. BALLASTING / DE-BALLASTING OF HOLD NO 3 IS NOT TO TAKE PLACE FOR REASONS OTHER THAN THE ABOVE. VESSEL HAS THE LIBERTY OF STEAMING AT SLOW SPEED OR STOP/BEING IDLE FOR THE PURPOSES OF DEBALLASTING / BALLAST EXCHANGE, IF REQUIRED AND ANY LOSS OF SPEED /TIME TO BE FOR CHARTERERS ACCOUNT.

CONSUMPION MAY INCREASE BY ABT 1.0 MT VLSFO/DAY DURING BALLASTING/DEBALLASTING/BALLAST EXCHANGE OPERATIONS AT PORT/SEA,OR IN COLD WEATHER FOR BOILER USE.

 

SPEED / CONS ARE ABT IN GOOD WEATHER UP TO MAX BF 4 AND SMOOTH SEA CONDITIONS AND NO ADVERSE CURRENTS OR NEGATIVE INFLUENCE OF SWELL, ON SSW DRAFT, NOT IN CONGESTED AREAS OR PASSING THROUGH STRAITS OR AREAS WITH POOR VISIBILITY AND PROVIDED NO BOTTOM FOULING DUE TO IDLE PERIODS OF 20 DAYS OR MORE. AN ADMISSIBLE PERIOD OF GOOD WEATHER HAS TO BE A PERIOD OF 24 CONSECUTIVE HOURS RUNNING FROM NOON TO NOON. EXTRAPOLATION OF “GOOD WEATHER” PERFORMANCE FOR “BAD WEATHER” PERIODS IS NOT ALLOWED. ADVERSE CURRENT HAS TO BE TAKEN INTO ACCOUNT WHEN ASSESSING VESSEL'S SPEED AND CONSUMPTION. HOWEVER, FAVORABLE CURRENTS ARE TO BE EXPRESSLY EXCLUDED FROM VESSEL'S PERFORMANCE ANALYSIS. IN CASES WHEN VOYAGES ARE FROM SEA BUOY TO SEA BUOY ON VOYAGES LESS THAN 48 HOURS AND 24 HOURS AFTER COSP/PRIOR EOSP OR COASTAL TRADE, ACTUAL CONSUMPTION FIGURES TO APPLY.

VESSEL HAS THE LIBERTY TO USE LSMGO FOR THE MAIN ENGINE WHEN SECA, ECA, MANOEUVERING IN/OUT OF PORTS, CANALS, RIVERS, RESTRICTED AREAS, SHALLOW & NARROW WATERS, FOR STARTING UP/TURNING ENGINES, BURNING SLUDGE AND IN ADVERSE WEATHER, BAD/COLD WEATHER, HOLD CLEANING AND BILGE PUMPING. MASTER HAS THE AUTHORITY TO DIVERT COURSE FOR SMOOTH RUNNING/SAFETY OF THE VESSEL. SPEED AND CONSUMPTION FIGURES IN FAIR WEATHER WITHOUT ADVERSE CURRENT,  POOR VISIBILITY, CONGESTION, NO NEGATIVE INFLUENCE OF SWELL UP TO BEAUFORT SCALE FORCE 4 / DOUGLAS SEA STATE 3 / WAVE AND SWELL COMBINED HEIGHTS UPTO 1.25 M. ABOUT ON SPEED AND CONSUMPTION CLARIFIED AS MEANING 5% ALLOWANCE ON CONSUMPTION AND 0.5 KNOTS ON SPEED, BOTH IN OWNERS FAVOR.  IT IS UNDERSTOOD THAT VESSEL NOT TO BE ORDERED TO SAIL ON ECONOMICAL SPEED/CONSUMPTION IN PIRACY RISKS AREAS. ALL DETAILS ABOUT AND GIVEN IN GOOD FAITH ANY SAVING IN CONSUMPTION MUST BE OFF-SET AGAINST ANY SPEED UNDERPERFORMANCE, ANY SAVING IN TIME MUST BE OFF-SET AGAINST ANY EXCESS CONSUMPTION, ANY SAVING IN FO MUST BE OFF-SET AGAINST INCREASED MDO AND VICE VERSA, AND ANY OVERALL SAVING ON INDIVIDUAL PASSAGE(S) MUST BE SET OFF AGAINST AN OVERALL LOSS ON OTHER INDIVIDUAL PASSAGE(S).

 

OWNERS ARE ENTITLED TO A CREDIT FOR ANY BUNKER SAVINGS, WHICH ARE TO BE CALCULATED AS THE DIFFERENCE BETWEEN MAXIMUM QUANTITIES OF BUNKERS THE ALLOWED TO CONSUME AS PER ABOVE AND THE QUANTITY OF BUNKERS ACTUALLY CONSUMED DURING THE VOYAGE. OWNERS ARE ENTITLED TO THE SAID CREDIT FOR BUNKER SAVINGS IRRESPECTIVE OF WHETHER THERE IS ANY SPEED CLAIM. IN THE EVENT THAT THERE IS A SPEED CLAIM, THE CREDIT FOR BUNKER SAVINGS SHALL BE SET-OFF AGAINST ANY LOSS OF TIME TO REDUCE OR EXTINGUISH SPEED CLAIM, AND IN THE EVENT BUNKERS SAVINGS ARE OF VALUE GREATER THAN SPEED CLAIM, OWNERS ARE ENTITLED TO CREDIT FOR REMAINING BALANCE OF BUNKER SAVINGS AFTER SETTING OFF SPEED CLAIM.

 

OWNERS ARE ENTITLED TO A CREDIT FOR ANY TIME SAVED, WHICH IS TO BE CALCULATED AS THE DIFFERENCE BETWEEN MAXIMUM TIME THE SHIP WAS ALLOWED TO COMPLETE THE VOYAGE AS PER ABOVE AND THE TIME ACTUALLY TAKEN TO COMPLETE THE VOYAGE.

 

OWNERS ARE ENTITLED TO THE SAID CREDIT FOR TIME SAVED IRRESPECTIVE OF WHETHER THERE IS ANY OVER-CONSUMPTION CLAIM. IN THE EVENT THAT THERE IS AN OVER-CONSUMPTION CLAIM, THE CREDIT FOR TIME SAVED SHALL BE SET-OFF AGAINST ANY OVER-CONSUMPTION TO REDUCE OR EXTINGUISH OVER-CONSUMPTION CLAIM, AND IN THE EVENT TIME SAVED IS OF VALUE GREATER THAN OVER-CONSUMPTION CLAIM, OWNERS ARE ENTITLED TO CREDIT FOR REMAINING BALANCE OF TIME SAVED AFTER SETTING OFF OVER- CONSUMPTION CLAIM.
